Terms and Conditions

Please carefully read our Terms and Conditions. They explain the policies, procedures, and rules applicable to all parties who subscribe to our services and/or use our website. Anyone subscribing to our services or accessing our website is bound by these Terms and Conditions, and must follow all rules, policies, and procedures. Use of our services or website is also subject to all applicable state and local laws, as well as those of the United States of America.

1. Information Provided To Us By Our Customers. All personal information provided to us by our customers will be protected as stated in our Privacy Policy and herein. We will not use customer information for any commercial purpose. All information collected is processed in strict adherence to our Privacy Policy. By providing us with any of your information, you consent to use of your information in accordance with our Privacy Policy and our Terms and Conditions, as stated herein.

Illegal activity by subscribers to My Parcel Guru's services and/or users of our website will be reported to law enforcement authorities, as required. In order to avoid being an unwitting party to fraud and any other illegal activities, My Parcel Guru reserves the right to inspect all packages it receives on your behalf. We will fully cooperate in any investigation of illegal activity. Our cooperation with law enforcement authorities may include, but is not limited to, the full disclosure of any violators identity and their actions while using My Parcel Gurus services or interacting with our website.

2. Your Address. My Parcel Guru will provide you with a street address for your use in the United States. My Parcel Guru is the sole owner of certain accounts located at this address. Our accounts are available to our subscribers (our Services) for purposes of sending and receiving packages and parcels. Our Service is provided to you (the Customer) and is subject to these Terms & Conditions, as well as any amendments made thereto. Additional rules and/or policies may be issued by My Parcel Guru, as is necessary, and our Service will be subject to them as well.

3. Services. My Parcel Guru services are limited to packages or parcels only. All letters, magazines or catalogs will not be held in Customer's account and will be discarded. We accept and forward packages up to 150 lbs.

4. Customer's Responsibilities. Customer must verify that they are 18 years of age or older. By subscribing to My Parcel Guru's Service, all Customers attest that they are 18 years of age or older and that they will not engage in any illegal activity. Violation of this policy by a Customer will result in the termination of our Service and immediate suspension of use of My Parcel Gurus website for any Customer discovered to be underage.

5. Holding Packages. My Parcel Guru will hold Customer's packages or parcels, which we receive, for the period of time specified in a Customers subscription plan. Should Customer fail to provide forwarding instructions or payment for his or her packages or parcels within that time, said items will be returned to the sender unless special arrangements have been made between the Customer and My Parcel Guru.

When a package has to be returned to sender, Customer shall be responsible for payment of the cost of any postage, forwarding fees, or necessary repackaging materials, and Customer agrees to pay any such costs in advance, if possible, or as soon as notified by My Parcel Guru thereafter.

6. Postage Due or COD Items. My Parcel Guru will not accept "postage due" and/or COD packages or parcels on behalf of Customer unless prepayment has been arranged with, and made to, My Parcel Guru by Customer. Notwithstanding the foregoing, My Parcel Guru retains sole discretion as to whether to accept such items.

7. Certified or Registered Packages. Unless otherwise specified by Customer, My Parcel Guru will not accept certified, registered, or other accountable packages or parcels on behalf of Customer.

8. Limits of Liability. In no event shall My Parcel Guru, or any of our employees, agents, vendors, or suppliers, be liable to Customer, or any other person or entity for any direct, indirect, special, consequential, or any other damages, should such damages arise out of or in connection with Customer's possession and/or use of Customers' account, and/or the use of, or inability to use, My Parcel Guru's website.

Customer agrees to indemnify, defend, and hold My Parcel Guru harmless from and against any and all claims, damages, expenses, or other costs, including, but not limited to, attorneys fees, suffered or incurred by My Parcel Guru, which arise from any or all of the following:

  • the Customer's possession and/or use of the account;
  • any failure of the U.S. Postal Service or other commercial carrier to deliver, or to timely deliver, any packages or parcels;
  • loss of or damage to any packages or parcels;
  • damage to packages or parcels held in Customer's account by any cause whatsoever; and/or
  • Customer's violation of any applicable federal, state or local laws.
 
Customer acknowledges that My Parcel Guru is not a shipping company but rather a shipping agent, and agrees to abide by the Terms and Conditions of shipping company e.g. UPS, DHL or FedEx, chosen for parcel forwarding.

9. How We Calculate Shipping. My Parcel Guru calculates shipping weight using both true (actual) weight and dimensional weight (which takes into account the amount of space a package takes up). Dimensional weight may apply to bulky, lightweight packages. We will base our shipping rate (Customer's cost) on whichever weight (true or dimensional) is heavier.

10. Customs Issues. Customer shall be responsible for paying any and all customs duties incurred in the destination country where Customers package or packages are sent. My Parcel Guru shall not be responsible for any misrepresentation of a package or its contents. See Prohibited Acts.

11. Preparation of Documents. By agreeing to these terms My Parcel Guru is thereby appointed by the Customer as the agent for preparation of shipping documents, with full power-of-attorney to act as such agent for the Customer to the extent allowed by law. If a certificate of origin for goods manufactured and originating within the United states, shippers export declaration (SED), airway bill or any other document is required to ship merchandise on behalf of customer, My Parcel Guru will file the required export information as its agent pursuant to this section.The Customer must acknowledge that it has a duty to and is solely liable for providing all information required by United States' laws and regulations, and maintaining all records as required under the customs or other government agency laws. My Parcel Guru assumes no responsibility to act as a record-keeper or record-keeping agent for the Customer.

12. Countries Subject to Embargo or Sanctions. My Parcel Guru will not ship packages or parcels, in any form, to any country, territory, or location, which is subject to embargo by the United States and/or subject to any sanctions by the United States. Those countries include but are not limited to Cuba, Iran, Libya, North Korea, Sudan, and Syria.

13. Consolidation of Packages. We will consolidate multiple packages going to the same destination, by repacking them together according to your instructions and as set out in your subscription plan, in order to provide lower shipping costs to our customers.

14. Prohibited Acts. All users (including Customers) of My Parcel Guru's website and/or Service are prohibited from engaging in any of the following acts:

  • Modifying or altering, or attempting to modify or alter, in any way, My Parcel Guru's website
  • Attempting to gain unauthorized access to secure parts of our website, our server, or any database connected with our website or with My Parcel Guru
  • Using our website or our Service for any purpose that is in any way connected with an illegal act or omission
  • Intentional and/or illegal misrepresentation of a package or its contents delivered to My Parcel Guru for shipping
  • Interfering with, or attempting to disrupt, the operation of My Parcel Guru's operations or website in any way.

Discovery of any such Prohibited Act by My Parcel Guru will result in the immediate and permanent suspension of Customer from the use of our website and termination of our Service to Customer.

 
15. Termination of Service. My Parcel Guru reserves the right to terminate or cancel Service to Customer and/or to deny access to our website for any reason. Proven allegations that Customer is using our services in any improper, illegal or fraudulent manner as determined by My Parcel Guru, will result in immediate cancellation of service to said customer. Upon termination of Service, My Parcel Guru will hold and forward any packages or parcels addressed to Customer for a period of 30 days from the date of termination or cancellation. Customer shall remain responsible for paying any costs associated with any postage, forwarding fees, or necessary repackaging materials.

16. Dispute Resolution. Should any dispute arise between My Parcel Guru and Customer, or any of their representatives, it shall be resolved in accordance with the laws of the State of Delaware, without regard to the conflicts of laws provisions thereof, and the parties agree that Delaware state and federal courts are the proper venue for any and all litigation that may arise.

17. Rights And Benefits Are Not Transferable. Any rights, benefits, or privileges which shall accrue to Customer by virtue of these Terms and Conditions and/or by receipt of Service from My Parcel Guru, are not transferable to any other person, entity, or third-party.

18. Terms and Conditions May Change. My Parcel Guru reserves the right to modify or update these Terms and Conditions at any time without prior notice. All changes will be reflected on this web page. It is Customers responsibility to remain current with any changes to these Terms and Conditions by periodically checking our website for changes and updates. Customer will be bound by these Terms and Conditions whether or not Customer has taken note of posted changes.

19. These Terms and Conditions Are The Final Word. No communications or conversations with My Parcel Guru representatives or employees shall have any effect on the content or applicability of these Terms and Conditions to Customer. The contents of these Terms and Conditions shall take precedence over any and all communications with My Parcel Guru employees or representatives.

20. Severability. If any paragraph or portion of any paragraph herein is found to be invalid, illegal, or unenforceable, all other paragraphs shall remain in full force and effect.

21. Failure To Enforce Is No Waiver. Should My Parcel Guru, or any of its representatives or employees, fail to enforce any of the provisions of these Terms and Conditions, such failure shall in no way constitute a waiver of any right or option to do so contained herein.
